Hit & Run Accidents
Tampa Car Accident Lawyer Representing Accident Victims Throughout Florida
Car accidents can be devastating, leaving innocent victims with painful injuries, property damage and the stress of dealing with the insurance companies. But when the negligent driver leaves the scene of the accident, this makes matters even worse. At the Capaz Law Firm, we are dedicated to helping car accident victims recover after an accident, including those injured in a hit and run accident.
What is a Hit and Run?
A “hit and run” accident occurs when a driver hits another vehicle, a bicyclist or pedestrian and then leaves the scene of the accident without stopping to offer help or exchange information. Though it is against Florida law to leave the scene of the accident, it still happens regularly for a variety of reasons. A hit and run driver may have been under the influence of drugs and alcohol and fled the scene to avoid a DUI arrest. Similarly, distracted drivers may not want to face the consequences of their negligent actions. Other times the driver may have a suspended license or arrest warrant and does not want to get involved with the police. And sometimes, the driver may not even realize they have hit a pedestrian; they may believe they have hit an animal or an object in the road, especially if the driver is distracted or intoxicated.
If the Hit and Run Driver is Found
Leaving the scene of an accident is a serious criminal offense. Additionally, those injured by the hit and run driver may seek compensation for their injuries including the costs of medical bills, lost wages and property damage, plus funeral expenses if a victim died due to the accident. At the Capaz Law Firm, we can help you hold the negligent party accountable for their actions and seek the compensation you need to recover.
If the Hit and Run Driver is Not Found
When a driver leaves the scene of an accident, it may take time to find them. Sometimes, the hit and run driver is never found. When this happens, you may look to your own insurance company for compensation. In Florida, motorists are required to have at least $10,000 of personal injury protection (PIP) coverage. Your PIP provider will cover 80% of your medical bills and 60% of your lost wages, up to the amount of your coverage. You may also look to any additional policies you may have including Uninsured Motorist coverage (UM) and Underinsured Motorist coverage (UIM) or your medical insurance coverage. We can help explain your insurance benefits and deal with the insurance companies on your behalf. We will do everything we can to ensure your insurance company provides you with the full benefit you deserve.
