According to The Times-Picayune, the family of a woman who was catastrophically injured in a tractor-trailer accident in New Orleans was recently awarded $51.5 Million. This is thought to be the largest jury award ever made to a single plaintiff in the Orleans Parish Civil District Court.

The plaintiff was injured in 2012 while she was in the parking lot of a Lowe’s Home Improvement store. Her husband’s 2007 Freightliner truck moved forward unexpectedly despite use of its emergency parking brake. The plaintiff and her husband tried to stop the tractor-trailer, but the large truck pinned the plaintiff under its wheels and dragged her for some time. Unfortunately, the accident caused the plaintiff to suffer crushing physical injuries and a severe brain injury, leaving her in a minimally conscious state under 24-hour care.

The lawsuit was filed against Daimler Trucks North America, KLLM Transport Services LLC, Empire Truck Sales LLC, Great West Casualty Company and St. Paul Fire and Marine Insurance Company. All of the named defendants were alleged to be linked to the manufacturing, ownership, operation, design, programming and the failure to deploy reasonable safety features, communicate defects and diagnose the truck.
